With the adoption of the new Civil Code, a number of changes have occurred that affect the daily lives of all of us. One of these concepts is "hidden defect". Today we will focus on the meaning of this term in relation to used cars.<\/strong> What is considered a hidden defect in a car?<\/strong><\/p>\n\n\n\n

A hidden defect is understood as a defect that the seller did not inform the buyer about and that the buyer could not recognize in a normal way. This defect is not immediately visible and only appears after a certain period of use of the car, often only a few days after the sale. The law sets a six-month period from the sale, during which a hidden defect can manifest itself. Typical examples include a defective turbo, fuel pump, coolant or oil leak, etc. If the defect appears within the six-month period, the law assumes that the vehicle was defective when it was taken over.<\/p>\n\n\n\n

What is the practice like with a hidden defect?<\/strong><\/h2>\n\n\n\n

In practice, proving a hidden defect can be more difficult than it seems. A hidden defect is not every defect that appears on a car during the first six months after sale. The seller is only liable for defects that the car had at the time of sale, not for those that arose from subsequent wear and tear.           Yes, that's right, the definition of a hidden defect in a car is not entirely clear. Not every defect that appears during the first six months after sale is automatically considered a hidden defect. The seller is not liable for defects that arise as a result of further wear and tear of the vehicle, nor for defects that correspond to the degree of wear and tear or use of the car. A hidden defect is one that was present at the time of sale, but was not obvious or the seller did not inform about it.<\/p>\n\n\n\n

          What to do if you discover a hidden defect?<\/strong><\/h2>\n\n\n\n

          Before claiming a hidden defect in a car, make sure that:<\/p>\n\n\n\n

          2. it is not an obvious defect, i.e. visible when inspecting the car<\/p>\n\n\n\n

          3. it is not a defect that corresponds to the degree of use or wear and tear of the vehicle<\/p>\n\n\n\n

          If a hidden defect appears in the vehicle, it is important to proceed correctly<\/a><\/strong><\/mark>:<\/p>\n\n\n\n

          1. Do not make repairs to the vehicle before making a claim so that the defect can be proven in its original condition.<\/li>\n\n\n\n
          2. Make a written complaint to the seller. If the seller is an entrepreneur (e.g. a used car dealership), he or she will write a complaint report together with the buyer. One copy will remain with the seller and the other with the buyer. After writing the report, the seller has 30 days to settle the complaint.<\/li>\n\n\n\n
          3. If the seller agrees to the complaint, agree in writing on the method of redress - repair, price discount or withdrawal from the contract.<\/li>\n\n\n\n
          4. If the seller rejects the claim and the buyer insists on it, you can have an expert opinion prepared and continue with the claim. If the expert opinion does not convince the seller, the case can be taken to court.<\/li>\n<\/ol>\n\n\n\n

            If possible, it is better to resolve the dispute amicably rather than going to court. Court proceedings can be time-consuming and costly. Reaching an agreement with the seller is often a more effective and less stressful way to resolve the dispute.<\/p>\n\n\n\n

            If the defect really did appear just a few days after you took possession of the car, you have a stronger position to succeed in a potential lawsuit.
